Terms of Service

Article 1 (Purpose)
These Terms of Service set forth the rights, obligations, and responsibilities between the Company and its members, as well as other necessary matters, in connection with the use of the guide matching and intermediary services provided through the Tapply platform operated by Mellive (MELLIVE).

Article 2 (Definitions)
1. “Company” refers to Mellive (MELLIVE), the entity that operates the Tapply platform.
2. “Member” refers to a person who has agreed to these Terms of Service and completed the membership registration process, thereby entering into a contractual relationship with the Company for the use of the services, and who is eligible to use the Tapply platform.
3. “Guide Member” refers to an individual or sole proprietor who registers on the Tapply platform and provides tour services to Traveler Members.
4. “Traveler Member” refers to a Member who searches for, books, or uses tours provided by Guide Members through the Tapply platform.
5. “Tour” refers to all service activities provided by Guide Members to Traveler Members, including travel, guidance, experiences, companionship, and related services.

Article 3 (Nature of the Services)
1. the Company provides an intermediary platform that connects Guide Members and Traveler Members and is not a contracting party to the tours provided by Guide Members. The actual tour services are provided by Guide Members, and the rights and obligations related to such tours shall, in principle, belong to Guide Members and Traveler Members.
2. Any contract related to a tour is entered into directly between a Guide Member and a Traveler Member, and the Company is not a party to such contract.
3. Except as required under applicable laws and regulations, the Company does not guarantee and shall not be responsible for the quality, safety, legality, or performance of tours provided by Guide Members.

Article 4 (Membership Registration and Use of Services)
1. A contractual relationship for the use of the Services is established when a Member agrees to these Terms of Service and completes the membership registration process.
2. Members shall provide accurate and factual information, and any responsibility arising from the provision of false or inaccurate information shall rest with the relevant Member.
3. Where necessary for the provision of the Services, the Company may request additional verification or the provision of additional information from a Member.

Article 6 (Limitation of Liability)
1. Primary responsibility for any accidents, disputes, losses, injuries, or property damage arising in connection with a tour shall lie with the Guide Member or Traveler Member who is attributable to the relevant cause.
2. Except as required under applicable laws and regulations, the Company shall not be liable for any of the following:

Any damages arising from the acts or omissions of a Guide Member or a Traveler Member
  – Any accidents or disputes occurring during the course of a tour
  – Any contracts entered into directly between Members without using the Tapply platform, or any disputes arising therefrom
  – Any interruption of the Services caused by force majeure events, including natural disasters or system failures
  – Any issues, accidents, damages, or disputes arising from matters that fall outside the scope of services agreed upon between the Guide Member and the Traveler Member through the Tapply platform at the time of reservation
3. Even in cases where the Company’s liability is recognized, such liability shall be limited to the extent permitted under applicable laws and regulations..

Article 7 (Restrictions on Use by Minors and Liability for Providing False Information)
1. This Service is not available to minors under the age of 19. If a minor registers as a Member or uses the Service by providing false information or using another person’s information, all responsibility arising therefrom shall rest solely with the relevant Member.
2. Even where the Company has taken reasonable measures to restrict minors from using the Service, if a minor gains access to the Service due to a Member’s provision of false information, the Company shall not be held liable unless there is willful misconduct or gross negligence on the part of the Company.

Article 8 (Restriction of Service Use and Account Suspension)
1. The Company may restrict the use of the Services or suspend or delete a Member’s account without prior notice if any of the following applies:
– A violation of these Terms of Service or applicable laws and regulations
– Engagement in illegal activities or infringement of the rights of others
– Conduct that is materially contrary to the purpose of the platform or the intent of service operation
2. Except as required under applicable laws and regulations, the Company shall not be liable for any damages arising from restrictions on service use, account suspension, or account deletion pursuant to Paragraph 1.

Article 9 (Payment and Refunds)
1. Matters related to payment and refunds for tours shall be governed by the refund and cancellation policy separately posted by the Company.
2. The Company acts solely as an intermediary in the payment process, and final responsibility for refunds shall rest with the Guide Member or be governed by the applicable refund and cancellation policy.

Article 10 (Personal Information Protection)
The Company complies with applicable laws and regulations relating to the protection of personal information, and matters concerning the collection, use, and processing of personal information shall be governed by the privacy policy separately posted by the Company.

Article 11 (Amendments to the Terms of Service)
1. The Company may amend these Terms of Service as necessary, to the extent that such amendments do not violate applicable laws and regulations.
2. If the Company amends these Terms of Service, the Company shall notify Members of the effective date and the details of the amendments through the Tapply platform prior to the effective date.
3. If a Member does not agree to the amended Terms of Service, the Member may discontinue use of the Services and terminate the service agreement.

Article 12 (Miscellaneous)
Matters not stipulated in these Terms of Service shall be governed by the relevant laws and regulations of the Republic of Korea and generally accepted commercial practices.

Effective Date
These Terms of Service shall take effect as of December 25, 2025.
